REGISTRATION
An application for registration can be made after the mini grid has been commissioned.

PERMIT
Ordinarily, an application for a permit should be made prior to the commencement of installation and constructions works. However, Regulation 10(3) of the NERC Regulations for Mini Grids, 2016, allows developers of mini grids with up to 100kW distributive capacity to commence operations as a registered mini grid operator pending when a response is received from NERC.

REGISTRATION
Compliance with MYTO calculation methodology is optional. Tariffs may be determined on a willing seller – willing buyer basis (“Negotiated Tariff”) subject to NERC’s right to intervene and set the tariff if it exceeds the threshold prescribed in Regulation 20(3) of the Mini Grid Regulations, 2016. The Negotiated Tariff must be documented in an agreement between the operator and electricity consumers representing 60% of the electricity output in that community. Such agreement must be submitted to NERC for its records.

REGISTRATION
Yes. NERC requires the submission of the agreement between the operator and the consumers stating the tariff) (referred to above) for its records.

Yes. However, the Commission may grant a derogation from this requirement upon an application by the mini grid operator.

No. However, Developers of registered mini grids are advised to apply the minimum standards set out in Annex 7 of the Mini Grid Regulations and apply the safety guidelines set out in Annex 6.

No. Registered Mini Grid Operators do not have rights to receive compensation. On the DisCo’s request, a Registered Mini Grid Operator will be required to de-commission and remove all its equipment within 2 months after the DisCo has started supplying electricity to the area.

Yes. If a DisCo extends its network to an isolated mini grid operated by the holder of a Mini Grid Permit, the permit holder is protected and may elect to either convert to an Interconnected Mini Grid Operator or transfer its assets to the DisCo in return for compensation.
